MORE ON THE PROFESSIONAL LIABILITY PLAN
Imagine This . . . Three IRS employees found themselves defendants in a lawsuit brought by an individual who was convicted of tax crimes. They were found guilty of leaking information regarding the investigation. The penalties ranged from $150,000 to $1,000,000 between the three of them. and...
A federal law enforcement officer pursuing a suspect on foot, and in the line of duty, accidentally runs into an innocent bystander. The person incurred several injuries and has decided to sue the officer for medical bills and lost wages due to missed work.
The reality is... Lawsuits against federal employees are increasing at an alarming rate. Members of the public and even fellow workers can bring personal lawsuits against you. The Federal Government does not guarantee you coverage or even an attorney in the event you are sued.
You are at risk whenever you are acting within the scope of your job; including delegating assignments, evaluations, working at your desk or meeting with the public. Away from your desk, you could be exposed to an even greater risk of lawsuits from private citizens. Frivolous or not, this could still cost you thousands of dollars.
The Federal Tort Claims Act states that the government can choose whether or not to defend you and can choose not to cover any monetary damages levied against you personally as well.
Fortunately, a solution now exists... "I truly believe that every federal employee needs this policy. Employees find themselves the subjects of proposals for discipline, subjects of Office of inspector General Complaints, EEO (discrimination complaints from fellow workers), and law suits from the public. Just yesterday, I defended an employee with 18 years of impeccable service who was removed from the government for failing to follow one instruction. She and a new boss butted heads for about 6 months and the new boss used one instance of failing to follow a vague instruction to remove the employee. Fortunately, the client had insurance and we were able to appeal the removal to the Merit Systems Protection Board. We had a hearing yesterday and got her job back last night. On her own, she could never have afforded to appeal the case and would be out on the street without a job." Peter Noone, Esq.Avery, Dooley, Post and Avery Boston, MA
